Personal Health Information Protection Act (PHIPA)

The Personal Health Information Protection Act (PHIPA) came into effect on November 1, 2004. This Act applies to all health information custodians (HIC) operating within the Province of Ontario and to individuals and organizations that receive personal health information from HIC.

This Act establishes rules for the collection, use and disclosure of personal health information. It balances individuals’ right to privacy with respect to their own personal health information with the needs of persons and organizations providing health care services to access and share this information.

The HIC is a person or organization who has custody or control of personal health information as a result of the work that they do or in connection with the powers or duties they perform (i.e. home for the aged, ambulance service, Medical Officer of Health).

The Region is the HIC for those departments collecting personal health information with the exception of the Medical Officer of Health who is the HIC for the Health Department.

An Agent acts for or on behalf of the HIC. The contact person for the Region and the Medical Officer of Health is the Regional Clerk who is an agent of the HIC.
