Sewer User Rate By-law
On July 1, 2022, Durham Region made changes to the Sewer User Rate By-law #90-2003 regarding the limit of repairs on private property related to sanitary sewer service connections.
However, on September 28, 2022, Regional Council repealed the Sewer User Rate By-Law changes. Durham Region has established a Reimbursement Program for homeowners who completed sanitary sewer service connection repairs on private property (up to one metre from outside the house foundation) on or after July 1, 2022.
Customers who purchased warranties from Service Line Warranties of Canada (SLWC), will be contacted by SLWC directly to advise of options for refunds and cancellations. Contact your insurance provider to explore options for coverage on private property.

Reimbursement Program
If you completed a sanitary sewer service connection repair on your residential property (from property line up to one metre outside the house foundation) between July 1 and September 28, 2022, you may be eligible for Durham’s Reimbursement Program.
To submit a Reimbursement Program claim for repair work on a residential sanitary sewer service connection please provide the following information by email to WorksTechnical@durham.ca:
- Invoice from the licensed plumber or contractor, on their letterhead, that shows:
- The date of the work
- The address of the property where the work was completed
- A description of the work completed by the plumber or contractor
- An itemized breakdown of the costs for the scope of work.
- The owner’s name and address (if different from the property address)
- Proof of payment to plumber (invoice receipt, e-transfer receipt, etc.)
Payments for eligible claims will be made to the individual specified as the owner, who will be required to sign a release form prior to the Region issuing reimbursement.
Upon receiving the required information, the Region will confirm receipt of the information via email and will begin a review including a site verification of work. Next, the Region will confirm when the review and investigation is complete, and advise if the reimbursement is approved in full, partially or denied.
The homeowner will be required to sign and return a release to authorize reimbursement, which will be provided via cheque and mailed to the property owner’s address.
Please note, the Reimbursement Program does not include restoration work for lawns, gardens, landscaping including sprinkler systems or driveways, etc. on private property.

Region of Durham Sanitary Sewer Service Repair Reimbursement Program Terms and Conditions The Regional Municipality of Durham (“Region of Durham”) is offering a Sanitary Sewer Service Repair Reimbursement Program (“Reimbursement Program”) to residential property owners who completed sanitary sewer service repairs between July 1, 2022 and September 28, 2022. In consideration for participation in the Reimbursement Program, a resident who submits a claim (“Claimant”) agrees to the following terms and conditions:
1. The Reimbursement Program is only available for repairs that were required at residential properties located within the Region of Durham between July 1, 2022 and September 28, 2022. The repairs must be for damage to the sanitary sewer service pipe that is located from the property line up to one (1) metre away from the foundation of the residential property. Repairs for sanitary sewer service infrastructure located inside the dwelling and within one (1) metre from the foundation outside the dwelling are not eligible for the Reimbursement Program. 2. Eligible costs under the Reimbursement Program include only reasonable cost elements of a project that are directly related to the repair of an existing sanitary sewer service pipe at the residential property. Eligible costs do not include any costs associated with restoration of the property resulting from the repair, including but not limited to, costs to restore any lawns, landscaping, gardens, driveways, sidewalks, fences, patios, and sprinkler systems. The maximum amount of reimbursement per residential property shall not exceed $15,000. Eligible costs may include insurance deductibles paid by the property owner for repair work on the sanitary sewer service pipe but shall not include any costs that the Claimant has already received reimbursement for through insurance, a warranty provider, or other means. 3. To submit a claim for reimbursement of eligible costs (“Claim”), a Claimant must provide the following information: a. Invoice from the licensed plumber or contractor on their letterhead that shows:
i. The date of work;
ii. The address of the property where the work was completed;
iii. A description of the work completed by the plumber or contractor; and,
iv. An itemized breakdown of the costs for the scope of work.
b. The owner’s name and address (if different from the property address).
c. Proof of payment (i.e. invoice receipt, e-transfer receipt).
4. All Claims must be submitted to the Region of Durham by mail to the address below or email to WorksTechnical@durham.ca before December 31, 2023 at 11:59 pm EST in order to be eligible for participation. Region of Durham Works Department

5. The Claimant represents and warrants that such party has due authority and right over the residential property in the Region of Durham and is authorized to submit a Claim and receive the compensation that the residential property may be eligible for under the Reimbursement Program. The Claimant acknowledges and agrees that only one Claim may be submitted per residential property.
6. Upon receiving the required information, the Region of Durham will confirm receipt of the information via email and will begin a review including a site verification of work. The Region of Durham will confirm when the review of the Claim is complete, and advise if the reimbursement is approved in full, partially or denied.
7. The Region of Durham reserves the right to require further proof of eligibility, in a form satisfactory to it, to verify the eligibility of a Claimant and Claim. Failure to provide proof of eligibility to the satisfaction of the Region of Durham may result in the disqualification of the Claimant and Claim, at the sole discretion of the Region of Durham. 8. The Claimant agrees to provide the Region of Durham with all information relating to the Claim and work completed at the residential property for purposes of the Claim and compliance with the terms and conditions, as requested by the Region of Durham. The Claimant agrees to participate in any follow up surveys, audits, inspections, evaluations or verifications conducted by the Region of Durham in connection with the Reimbursement Program. The Region of Durham reserves the right to independently verify the information in the Claim and that the Claimant has satisfied all requirements to receive payment of the reimbursement.
9. The Region of Durham shall have the right in its absolute discretion to decide whether or not the Claim is eligible for reimbursement under the Reimbursement Program. The Claimant may be disqualified and no longer eligible for the reimbursement payment if the Claimant does not comply with the terms and conditions herein or if any information provided by the Claimant is untrue, incomplete or inaccurate. Decisions of the Region of Durham will be final and binding on all Claimants without right of appeal.
10. Payment for approved Claims will be provided via cheque and mailed to the property owner’s address. Payments for eligible claims will be made to the individual specified as the owner and be subject to the owner returning a signed release form prior to the Region of Durham issuing reimbursement.
11. Payment of the approved Claim by the Region of Durham is also subject to the Claimant complying with all terms and conditions listed herein, including but not limited to the eligibility requirements.
12. The Claimant agrees and acknowledges that the Region of Durham does not provide any warranty over the work performed by the Claimant, the Claimant’s contractor, and by any other third party vendor that the Claimant retained to do the work for which the Region of Durham may provide reimbursement for under the Reimbursement Program.
13. By submitting a Claim, each Claimant consents to the Region of Durham collecting, using and disclosing the personal information submitted with the Claim for the purposes of administrating the Reimbursement Program, and all personal information will be handled in accordance with the Durham Region Privacy Statement and the Municipal Freedom of Information and Protection of Privacy Act.
15. The Claimant acknowledges and agrees that the Region of Durham will not be liable for any direct, indirect, special or consequential damages, costs or losses arising from the repair work to the sanitary sewer at the residential property that was completed by the Claimant and the Claimant’s contractors or from any actions, omissions, negligence or misconduct by the Region of Durham. 16. Any payment for eligible costs to the Claimant is subject to the availability of funds in the Reimbursement Program, and the Reimbursement Program may be terminated or discontinued at any time by the Region of Durham, in its sole discretion, and without further notice. The Region of Durham shall not be responsible for any costs, losses, or damages incurred by the Claimant arising out of, relating to, or resulting from the termination or discontinuation of the Reimbursement Program. |
